The Prosecutor’s Office of the Prosecutor’s Office considers that the file, part of the OPEKEPE case, which was formed for possible criminal responsibility of the ruling party’s sitting MPs, Charalambos Athanasiou and Tasos Hadjivassiliou, as well as the former President of the Agricultural Payments Organization Dimitris Melas, should be put on file.
The Prosecutor’s Office conducted a preliminary examination, following the transmission of a relevant document of the European Public Prosecutors, to investigate the possibility of the two MPs committing the offence of instigating a breach of duty, an act “allegedly committed by the 09.09.09.2021 to 08.12.2021 Dimitris Melas of Stavros, President of OPEKEPE during the period in question” as stated by the Prosecutor’s Office.
The file was forwarded to the Prosecutor’s Office for investigation, as this particular offence does not fall within the competence of the European Public Prosecutor’s Office. After conducting an investigation, the Public Prosecutor’s Office considers that there are no indications of instigating a breach of duty for these individuals and therefore considers that the case file should be placed on file.
The two MPs, after their immunity was lifted by the Parliament, were summoned to explain themselves as suspects in the context of the prosecution investigation. The Prosecutor’s Office is also putting the case on file for Mr Melas as the alleged natural perpetrator of the act under investigation. The decision on whether or not to confirm the filing will be made by the Prosecutor’s Office of the Court of Appeal.
